Sexual intercourse or sodomy of a minor under 10
Information on the crime of sexual intercourse or sodomy upon a minor ten (10) years old or younger is found at California penal code section 288.7(a).
PC 288.7(a) Law (Abbr.)
PC 288.7(a) Any person 18 years of age or older who engages in sexual intercourse or sodomy with a child who is 10 years of age or younger is guilty of PC 288.7(a).
Sexual intercourse means any penetration, no matter how slight, of vagina by the penis. Ejaculation is not required to prove sexual intercourse.
Sodomy means any penetration, however slight, of the penis of one person into the anus of another person.
PC 288.7(a) Sentence & Punishment
Probation Sentence: A probation sentence is period of supervision instead of an actual jail or prison sentence. Probation sentence are not allowed in PC 288.7(a) cases.
Sex Offender Registration: If found guilty of lewd and lascivious acts on a minor under 14 (PC 288(a)), the defendant will be ordered to register as a sex offender pursuant to PC 290. For more information please see sex offender registration requirements.
